RESOLUTION AND PROCLAMATION OF SPECIAL

HOSPITAL DISTRICT AD VALOREM TAX ELECTION

WHEREAS, the Board of Trustees of the South Central Colfax County Special Hospital District which includes the following facilities: Colfax General Long Term Care (Springer); Colfax Laboratory Services (Springer); Cimarron Healthcare Clinic (Cimarron); and Moreno Valley Healthcare Clinic (Angel Fire), (herein the “Board” and the “District,” respectively), in the County of Colfax and State of New Mexico, has determined that a Special Hospital District Ad Valorem Tax Election, (herein, the “Election”) be held on May 30, 2023, pursuant to Sections 4-48A-1 et seq., 1-22-1 through 1-22-20, and 1-24-1 through 1-24-6, NMSA 1978; and

WHEREAS, pursuant to Section 4-48A-16, NMSA 1978, the Board has determined, and does hereby determine, that there should be submitted to the electorate at said Election, the question of whether or not a property tax of $4.25 per each $1,000.00 of net taxable value of property allocated to the District under the Property Tax Code should be imposed for four (4) years, for the purposes of funding the current operations and maintenance of hospitals, including hospital facilities owned and operated by the special hospital district or for hospitals operated as provided in Subsection B of Section 4-48A-11, NMSA 1978, and to pay the operational costs of the special hospital district.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE SOUTH CENTRAL COLFAX COUNTY SPECIAL HOSPITAL DISTRICT CONSTITUTING THE GOVERNING BODY OF SAID DISTRICT, IN THE COUNTY OF COLFAX AND STATE OF NEW MEXICO:

Section 1. On the 30th day of May, 2023, there will be held in the South Central Colfax County Special Hospital District, Colfax County, New Mexico, a special hospital district election for the purpose of submitting to the qualified electors of the District the question of whether or not the imposition of a property tax should be continued for the purpose of funding the current operations and maintenance of hospitals and to pay the operational costs of the District.

Section 2. Voting shall be by mail ballot only pursuant to Section1-24-3(C), NMSA 1978. There will be no polling places for the election.

Section 3. At such Election, the following question shall be submitted to such qualified, registered electors of the District:

“Shall the Board of Trustees of the South Central Colfax County Special Hospital District, which includes the following facilities: Colfax General Long Term Care (Springer); Colfax Laboratory Services (Springer); Cimarron Healthcare Clinic (Cimarron); and Moreno Valley Healthcare Clinic (Angel Fire), County of Colfax, State of New Mexico, be authorized to continue the imposition of a property tax of $4.25 per each $1,000.00 of net taxable value of the property allocated to such District under the Property Tax Code for the property tax years of 2024, 2025, 2026 and 2027 for the purposes of funding the current operations and maintenance of hospitals, including hospital facilities owned and operated by the special hospital district or for hospitals operated and maintained by the special hospital district pursuant to an agreement with a political subdivision as provided in Subsection B of Section 4- 48A-11, NMSA, 1978, and to pay the operational costs of the special hospital district?”

Section 4. The tax contemplated by the tax question shall be in addition to any tax imposed to pay debt service on any bonds or for any other purpose. Such ad valorem tax shall be authorized pursuant to the Special Hospital District Act, Sections 4-48A-1, et seq., NMSA 1978, as amended.

Section 5. A person is a qualified elector of the District if he or she is a citizen of the United States, at least 18 years of age on the day of the Election and a resident of District on the day of the Election. In order to vote, qualified electors of the District must have previously registered with the County Clerk of Colfax County in accordance with law. Any qualified elector of the District who is not now registered and who wishes to vote at such Election should register during regular office hours prior to 5:00 p.m. on May 2, 2023, being the twenty-eighth (28th) day immediately preceding the Election at the office of the County Clerk of Colfax County, Colfax County Courthouse, Raton, New Mexico, or with any registration agent at a designated agency as provided in Sections 1-4-47, NMSA 1978 -1-4-49, NMSA 1978.

Section 6. As provided in Section 1-24-3(A) and 1-24-3(B), NMSA 1978, the mail ballots shall be mailed to each registered voter no later than May 2, 2023, being the twenty-eighth day prior to the election, or as soon as practicable thereafter. The return envelope for the ballot shall be postage-paid.
